Terms of Use

The terms that govern using the Bastah app and website, and the rights and obligations of customers, sellers and Bastah.

This is an English translation for convenience. The Arabic version is the official text, and it prevails if the two versions differ. Read the Arabic version

1. Definitions

  • Bastah, we or us: [Legal entity name], Amman, Jordan, the operator of the Bastah app and the website bastah.me.
  • The Service: the Bastah app, the website, and all the features they offer.
  • User or you: anyone who creates an account or uses the Service.
  • Store: a store page that a user creates in the Service to show their products, whether it’s an online store or a home business.
  • Seller: the user who owns or manages a store.
  • Customer: the user who browses stores, messages them, or sends them an order.
  • Order: a structured card sent in the chat between the customer and the seller when the customer taps “Send order”.
  • Content: everything published or sent through the Service, including text, photos, reviews, store and product information, and messages.

2. Accepting the terms

By using the Service, or by creating an account and explicitly agreeing when you sign up, you agree to these terms and to the Privacy Policy and the Community Guidelines, which are an integral part of these terms. If you don’t agree, please don’t use the Service.

3. Eligibility and your account

  1. You must be 18 or older and legally able to enter into a contract.
  2. You sign in with a code sent to your email. You’re responsible for protecting your email and your device, and for all activity on your account.
  3. You must give accurate information and keep it up to date. You may not impersonate any person or organization.
  4. You can delete your account anytime in the app, or as explained on the Delete account page.

4. What the Service is: Bastah only connects you

  1. Bastah is an intermediary platform that brings stores together in one place and lets customers and sellers talk directly. Bastah is not a seller and is not a party to any sale.
  2. There are no payments in the app. Bastah doesn’t receive, hold or process any money between the customer and the seller.
  3. Bastah doesn’t provide delivery. Delivery, its timing and its cost are agreed between the customer and the seller.
  4. An order card is a request, not a final sales contract. The total it shows is an estimate. The final price, payment method, delivery and any other details are agreed by the customer and the seller in the chat, and any agreement between them is a direct relationship between them alone.
  5. Bastah doesn’t guarantee products. We don’t guarantee their quality, safety, match with the description, legality or availability, nor that either party will keep what they agreed. We review stores before they appear (section 6), but this review is not a guarantee or an endorsement of the seller or their products.
  6. The seller is responsible for complying with consumer protection, tax and licensing laws.

5. Seller obligations

By opening a store, the seller agrees to the following:

  1. Accurate information: the store’s information, products, prices and photos are accurate, current and not misleading, and the photos show the actual products or represent them honestly.
  2. Legal products: they sell only products and services allowed in Jordan, and don’t list any of the prohibited products.
  3. Licenses: they obtain and maintain any license or registration the law requires for their activity.
  4. Home-made food and cosmetics: they follow health, hygiene and food-safety requirements, and the licenses and requirements of the relevant authorities (such as the Jordan Food and Drug Administration and municipalities) where they apply, and they state the ingredients and common allergens when asked. Bastah currently relies on the seller’s commitment to this, and may ask for proof at any time.
  5. Used products: allowed, as long as the product name or description clearly says it’s used and describes its condition.
  6. Fair dealing: they reply to customers reasonably, keep what they agree on, and never ask a customer for card details, passwords or sign-in codes.
  7. Responsibility for the team: if more than one person runs the store, the account owner remains responsible for everything published in it.

6. Store review, refusal, suspension and deletion

  1. Every new store is reviewed by the Bastah team, and appears to people only after it’s approved.
  2. Changing the identity of an approved store (name, handle, category and logo) goes through a new review, and the current version stays visible until it’s approved. Other details update right away.
  3. Refusal: Bastah may refuse any store or change that doesn’t follow these terms or the guidelines, and will give the reason. The seller can make changes and send it again.
  4. Suspension and hiding: Bastah may suspend any store or account, or hide any product, review or content, if it breaks these terms, the guidelines or the law, or if it puts users at risk. We’ll give the reason unless the law prevents it or doing so would be risky.
  5. Deletion: for serious or repeated violations, Bastah may delete the store or close the account.
  6. Appeals: you can appeal any decision through “Bastah Support” or at [email protected], and we’ll review your appeal.

7. Chats and orders

  1. A chat between a customer and a seller is private to them. The Bastah team only sees it when there is a report connected to it, as described in the Privacy Policy.
  2. Chats may not be used for harassment, repeated unwanted messages, fraud or any prohibited content.
  3. Bastah sets reasonable limits on the number of messages, orders and new chats to prevent abuse.
  4. Either party can block or report the other at any time.

8. Reviews

  1. Users review stores and products based on a real experience. Only someone who has messaged a store or sent it an order can review it.
  2. Fake reviews, sellers reviewing their own store, buying reviews, or pressuring users to change their reviews are not allowed.
  3. Sellers can reply publicly to reviews, respectfully.
  4. Bastah may hide any review or reply that breaks the guidelines.

9. Content, ownership and license

  1. Your content is yours. You keep all your rights to the content you publish.
  2. License to Bastah: by publishing content in the Service, you give Bastah a non-exclusive, royalty-free, worldwide license, which it may sublicense to its service providers, to host, store, display, copy, resize and reformat the content in order to run and present the Service.
  3. Use in promotion: this license includes using the names, logos and product photos of approved stores to promote Bastah and the store itself, including on social media such as Instagram. A seller can ask at any time for their content to be removed from promotional material at [email protected], and we’ll remove it within a reasonable time from the posts we control.
  4. The license ends when the content or the account is deleted, except for what stays with the other party in chats and reviews as the Privacy Policy explains, and what must be kept by law.
  5. You confirm that you hold the rights needed for everything you publish, and that it doesn’t infringe anyone else’s rights, including intellectual property, trademark and privacy rights.
  6. Bastah’s property: the name “Bastah”, its logo, design and software belong to Bastah and may not be used without written permission.
  7. Infringement: if you believe content on Bastah infringes your rights, write to us at [email protected] with the details, and we’ll take the appropriate action.

10. Prohibited use

In addition to the Community Guidelines, you may not:

  • Break any Jordanian law, including the Cybercrime Law and the Electronic Transactions Law.
  • Try to gain unauthorized access to the Service or to other people’s data, disrupt the Service, or test it for vulnerabilities without following the vulnerability reporting terms in the Privacy Policy.
  • Collect user or store data by automated means, or use it for purposes other than the Service.
  • Use the Service for fraud, money laundering, or misleading promotion of other platforms.

11. Reports, blocking and enforcement

  1. You can report any store, product, review, message or user from inside the app.
  2. The Bastah team reviews reports and may take the appropriate action: a warning, hiding content, refusal, suspension, deletion, or informing the relevant authorities when necessary.
  3. Abusing reports is not allowed, and there are limits on how many you can send.
  4. A suspended user can’t publish any content or send messages or orders, but can still contact “Bastah Support”, read their data and delete their account.

12. Fees and paid services

  1. Getting started on Bastah is currently free for customers and sellers, and Bastah takes no commission on agreements between customers and sellers.
  2. In the future, Bastah may add optional paid services or plans (such as extra features for sellers). These terms don’t mean the Service will always be entirely free, and no fee will be charged to you without telling you in advance and without your agreement to the paid service.
  3. Accounts are subject to usage limits (such as the number of stores or products), and these limits may change depending on the plan.

13. Disclaimer

  1. The Service is provided “as is” and “as available”. We make reasonable efforts to keep it available and secure, but we don’t guarantee that it will work without interruptions or errors.
  2. Bastah is not responsible for products, their quality, safety, delivery or payment, nor for any dispute between a customer and a seller. We’ll help as much as we can through reports and account actions.
  3. Bastah is not responsible for content published by users, but takes the appropriate action when it becomes aware of content that breaks the rules.

14. Limitation of liability

To the fullest extent allowed by Jordanian law, Bastah is not liable for any indirect or consequential damages, including lost profits, data or reputation, arising from using or being unable to use the Service, or from dealings between users. This section doesn’t exclude any liability that can’t legally be excluded, such as liability for fraud or gross negligence.

15. Indemnity

You agree to compensate Bastah for any claim, loss or reasonable expenses (including legal fees) arising from your breach of these terms or the law, from your content, or from your dealings with another user.

16. Changes to the Service

We may develop the Service, change its features, pause it for maintenance, or stop part of it. We’ll try to announce in advance any change that affects you significantly.

17. Changes to these terms

We may update these terms when the Service or the law changes. The last-updated date and the version number appear at the bottom of the page. For any material change, we’ll let you know in the app and ask you to accept the new version before you continue using it.

18. Governing law and jurisdiction

  1. These terms are governed by and interpreted under the laws of the Hashemite Kingdom of Jordan.
  2. The courts of Amman have jurisdiction over any dispute arising from them, unless the law grants another right that can’t be waived.
  3. We encourage resolving any disagreement amicably first, by contacting us.

19. Language

The Arabic text of these terms is the official text. If it conflicts with any translation, including this English one, the Arabic text prevails.

20. General

  1. If any section is found invalid, the remaining sections stay in effect.
  2. Bastah not enforcing a right doesn’t mean it gives up that right.
  3. You may not transfer your rights or obligations under these terms without our agreement. Bastah may transfer them in a merger or a transfer of its business.
  4. These terms, together with the Privacy Policy and the Community Guidelines, are the entire agreement between you and Bastah about the Service.
